The Mumbai bench of NCLT has accepted the petition filed by the public sector Bank of India under the Insolvency and Bankruptcy Code (IBC).
In this petition, a default in loan payment of Rs 127.86 crore was claimed.
What Was Said In The Order?
In its order passed on March 28, a two-member bench of NCLT said,
“Because of the prevailing facts and circumstances, it is necessary to initiate corporate insolvency resolution process (CIRP) in the case of the debtor company MEP Infrastructure.”
Apart from this, realty company MEP Infrastructure has also been given protection from any lawsuit, direction, and transfer under Section 14 of IBC.
The company had secured some financing from the Bank of India under the Multiple Banking Arrangement (MBA) in March 2010. But she was not able to pay it on time.
After this, the bank filed a petition before NCLT to initiate an insolvency process.
Along with accepting the petition, an interim resolution professional has also been appointed who take control of the company.
